In the absence of any statute or clear precedent imposing an additional fetter, a private person need not obtain the consent of the Secretary for Justice before applying for leave to bring criminal contempt proceedings; the sole required gatekeeper is the court under Order 52, and Article 63 Basic Law does not extend to bar private initiation of contempt applications.
