Because a bankruptcy order had been made against Tang Jr and no leave had been granted for him to continue the summons, the court lacked jurisdiction to allow him to proceed and therefore adjourned his summons (HCA1570/2012) sine die with no order as to costs; separately, because of unsatisfactory evidence of service, the inter partes nature of TLM's summons, the short time since filing and D1's stated intention to oppose, the court refused to hear the TLM summons substantively and instead granted specific directions and an adjournment for substantive argument to a date to be fixed.
