The application for an immediate substantive order for sale was adjourned because the plaintiff failed to produce essential evidence (valuation report, draft order, correspondence showing the positions of the Director of Lands and the trustees) and the defendant was entitled to file affidavit evidence; however, the court accepted that s12(2) of the Bankruptcy Ordinance meant leave of a High Court Master was not required for the plaintiff to proceed.
