By majority (2–1) the Full Bench held that a writ of fieri facias issued in Form 53 (including the capias wording where properly included) constitutes a lawful mode of execution authorizing the bailiff to arrest and deliver judgment debtors to prison without a judge's prior committal order; accordingly habeas corpus did not lie and the originating motion was dismissed.
