The application was dismissed because the claimant relied on incorrect procedures: s.12 MPPO did not apply to voluntary undertakings in the Consent Order, and Order 45 r.6 could not be used to convert undertakings into an order for payment or to prescribe the mode of payment; additionally the applicant failed to prove special or exceptional circumstances to justify leave after a 12‑year delay and failed to properly plead or prove the alleged outstanding sums.
