In the exceptional circumstances where defence counsel expressly advanced an unduly high starting point and enhancement in open court and the judge adopted that figure, the Court will grant leave to appeal out of time and interfere with sentence; on the facts the appropriate starting point was around 20 years with an international enhancement of about one year, yielding a sentence after a one‑third discount of 14 years, so the original sentence of 14 years 8 months was reduced to 14 years.
