Although the former solicitors failed to make reasonable inquiries and thereby caused additional costs by suing the wrong party, the court was not satisfied on the summary show‑cause material that their conduct reached the level of gross neglect or misconduct necessary to justify a wasted costs order; accordingly the application for a wasted costs order was dismissed.

Applying s5 and s11(7) MPPO and the authorities, the court assessed needs and the respondent's resources (including undertakings and access to family funds/loans) and varied the interim order: respondent to pay interim maintenance for each child HK$30,000 per month (backdated to 12 Aug 2020) and ordered an order nisi for maintenance pending suit for the petitioner of HK$4,800 per month (to be made absolute in 14 days), accepted respondent's undertaking to continue to pay school fees and transport and awarded party and party costs to the petitioner to be taxed.

The court refused to award indemnity costs for the entire action but found the plaintiff consciously concealed her resumption of work from March 2017 onwards, conduct sufficiently serious to take the case out of the norm; accordingly the plaintiff must pay the 2nd defendant's costs on a party‑and‑party basis up to 1 March 2017 and on an indemnity basis from 1 March 2017 to discontinuance, and must pay the 2nd defendant's costs of the contribution and indemnity proceedings on a party‑and‑party basis.
