The Court held that the plaintiffs' solicitors' files sought were prima facie protected by solicitor-client privilege and not producible; documents from earlier, different syndicated loans involving different parties were not sufficiently relevant to justify disclosure for construction or rectification of the 17 August 1981 documents; therefore the appeal against the refusal of those heads of discovery is dismissed. However, the Court exercised its discretion to vary the costs order below, substituting an order that the costs of the discovery application be costs in the cause.
