The Court certified two questions of public importance relating to whether a defendant in an incitement prosecution may raise the legality of a police prohibition as a defence and, if so, the correct approach to such a challenge; leave to appeal on those certified questions was granted and the appeal was listed for hearing, as the questions merited consideration at the final appellate level.
