Cooling towers were not shown to be part of the building or a specified installation in the Third Schedule; maintenance of those cooling towers therefore did not amount to maintenance of the building or "construction work" under the statute, and the magistrate also addressed the incorrect statutory failure; accordingly the conviction under the Construction Sites (Safety) Regulations could not stand and must be quashed.
