The judge concluded there was no reasonable prospect of success on appeal because the trial judge's factual findings on credibility, the existence and timing of hoardings, and the necessary intention to exclude others were supportable by the evidence and not plainly wrong, no improper shift of burden occurred, and therefore leave to appeal under s63A(2) was refused.
