The court accepted contemporaneous evidence that Madam Wong instructed solicitors and signed Chinese instructions; the registered 2nd Notice of Severance validly severed the joint tenancy so KT is at most a tenant in common and, on the primary facts, a bare trustee for Madam Wong; separately, Clarence proved the elements of proprietary estoppel (assurances by Madam Wong, reliance and detriment) entitling him to remain in occupation during Madam Wong's lifetime and defeating KT's eviction and mesne profit claims.
