The cause of action accrued when SCG failed to pay within a reasonable time after the Award and demand (held to be at the latest 8 April 2011), so the six-year limitation expired on 8 April 2017 and enforcement in Hong Kong was time-barred when CL applied on 6 February 2018; suspension for Mainland enforcement is not available absent statutory provision.

The court held that the plaintiff’s pleaded causes of action in breach of contract and negligence accrued on or by 18 January 2008 and were therefore time-barred when the writ was issued on 13 January 2016, so those parts of the Statement of Claim were struck out; however the proposed tort of unlawful interference (Second Amended Claim) was not shown to be plainly and obviously time-barred or abusive and leave to amend to plead that claim was granted; other grounds of res judicata/estoppel and embarrassment failed; consequential directions and costs orders were made accordingly.

The court found on the facts that the Plaintiff and his family had continuous, exclusive factual possession and the requisite intention to possess Lot No.525RP from 1954 and therefore acquired a possessory title extinguishing Mr Li's registered title by 12 March 1988 at the latest; further, on statutory construction the Extension Ordinance did not operate to create a fresh cause of action that would defeat that possessory title, so the Plaintiff's possessory title is good against the Defendants.
