The judge accepted the Plaintiff's credible oral evidence that the written agreement was replaced by the oral agreement, found the Plaintiff performed his obligations, treated the payments made as part payments/acknowledgements such that limitation did not run until the last payment in October 2008 under Limitation Ordinance s23(3), and held the Defendant failed to rebut the Plaintiff's case; accordingly judgment was entered for the Plaintiff and costs for the video-link application were ordered on an indemnity basis.
