Because Saunders J had already found the 2nd and 4th Plaintiffs in breach of clause 2.2(d), and because the Defendant proved loss by uncontradicted evidence from its liquidator and an expert valuer that the three properties were worth HK$29,000,000 as at the date of Saunders J's judgment, the proper measure of damages is HK$29,000,000; interest is payable from 4 January 2010 at judgment rate and costs are awarded to the Defendant.
