Leave was refused and the appeal dismissed because, although the trustees’ proprietary claim was not shown to be clearly unsustainable, there were no special circumstances justifying continuation of the Action; the Liquidators were competent and duty‑bound to determine the claim more expeditiously and cheaply within the liquidation and any aggrieved party could obtain focused court determination later under the Companies Ordinance.
