The Court refused leave to adduce the Chi Affirmation because the Applicant failed to satisfy the first Ladd v Marshall condition: the information as to fixed payments to Listing Review Committee members was publicly available or reasonably discoverable before the hearing, and the Applicant did not explain why it could not with reasonable diligence have obtained that evidence earlier; consequently the amendment to the Notice of Appeal to advance the new apparent‑bias ground was refused and the 1st Summons dismissed.
