Collateral contracts arose on submission of each tender; where tender conditions expressly contained a Suspension Clause the Government was entitled not to consider tenders submitted while the contractor was suspended; for the first invitation a term with the same effect as the Suspension Clause was implied to give business efficacy; accordingly the Government lawfully did not consider the appellant's tenders and the appeal must fail.
