Physical discomfort or chest pain, without evidence that sampling was impossible or would prejudice medical treatment, does not constitute a reasonable excuse to refuse a breath test; the hospital doctor raised no objection to sampling, so the refusal conviction was upheld. The plastic covering was properly characterised as rubbish and the act of dropping/refusing to retrieve it constituted throwing/laying, so the littering conviction was upheld.
