On the balance of probabilities the High Court found both parties were equal tenants in common; neither party proved entitlement to a greater beneficial share or proved the alleged loans; the defendant had unjustifiably excluded the plaintiff from possession and must pay compensation of HKD 2,100 per month from 1 September 1991 until delivery of vacant possession; the court ordered sale under s.6 of the Partition Ordinance with proceeds paid into court and split equally subject to deduction from defendant's share for compensation.
