The court held that, having regard to the true nature of the payments and the statutory purpose of the MLO, the Relevant Sums constituted prohibited "costs, charges or expenses" or "remuneration or reward" under s27(3), and that persons acting through the C&W Representatives were acting in collusion with the money lender (Credit One) as they cooperated to facilitate the loan to the borrower’s prejudice; accordingly those sums are recoverable or may be set off under s27(4).
