The appeal was dismissed because the Plaintiff, as administratrix and registered tenant-in-common for the deceased's share (and with letters of administration and consent from co-owners), has legal capacity to sue for possession and mesne profits in respect of that share; tenants-in-common may enforce their separate interests without joining all co-owners, so the strike out application for non-joinder lacked merit.
