The First DFA was valid and binding: the Plaintiff's non est factum defence failed on all three limbs, her lack of appointment as administratrix de bonis non at the time of signing did not affect the validity of the DFA entered into as a legatee and as executrix once communicated, and there was no estoppel preventing the Defendants from relying on the First DFA; accordingly the counterclaim compelling transfer of the Share to the 1st Defendant succeeds and the Plaintiff's claim is dismissed.
