The magistrate restricted his analysis to whether the defendant expressly raised self-defence rather than whether the defence was raised on the whole of the evidence; because there was evidence that could have raised self-defence and the magistrate did not properly direct himself on the burden to disprove it beyond reasonable doubt, the conviction could not stand and was quashed.
