The court held that 'authorised person' in s.2 of the Crown Lands Ordinance is limited to persons (whether public officers or others) acting on directions given under the specified sections (eg ss.6/12) and does not extend to public officers generally acting under s.13; because PW2 was not such an 'authorised person' the elements of s.16 were not made out and the s.16 conviction was unsafe and therefore quashed. The single High Court judge would not substitute a conviction under s.23 and instead allowed the appeal and quashed the conviction.
