The Court refused leave because there was sufficient independent evidence linking the applicant and Kan—notably Choi's testimony that he met the applicant who handed him money at Mei Wong Kitchen and shared it with Kan—permitting application of the co-conspirators rule; the magistrate was entitled to accept parts of witness evidence and reject others without bias; allegations of coaching did not show a departure from accepted norms amounting to grave and substantial injustice.
