The magistrate lawfully committed the applicant: admissible expert evidence and admissions established that the offences were offences against Australian dangerous drugs laws punishable by at least twelve months and that the acts would constitute offences in Hong Kong; the authority to proceed contained sufficient particulars so the magistrate was not obliged to examine the foreign warrants; the admitted fact satisfied s.4(3) protections; and non-compliance with specified provisions of Part III did not invalidate the committal under the Act.
