The statutory demand was set aside because the only undisputed element of the claimed debt (costs of $6,100) was below the statutory bankruptcy threshold of $10,000 so there was no basis for a bankruptcy petition; accordingly the demand could not fulfill its statutory purpose and must be set aside under the court's powers in r48(5)(d) and related authorities.

Given the paramountcy of the child's welfare, the court found joint custody appropriate to encourage parental cooperation and ensure one parent in Hong Kong can make urgent decisions; care and control allocated to the mother because no care/control dispute existed; access was structured to reflect current flight schedules and child's age; restraining order against mother was dismissed as unmeritorious; court lacked jurisdiction to change foreign birth registration but directed amendment steps and fee liability; maintenance fixed at HK$3,500 monthly to share child's demonstrated expenses.
