Grant of leave was refused because applicants failed to act promptly after becoming aware of the estate administration (notably after CMK's first letter of 6 Feb 2023), the delay of 2 years 7 months was unjustified, and applicants failed to establish an arguable case under s3(vi) because the only evidence of maintenance was free accommodation and they provided inadequate disclosure of their own assets; accordingly paragraph 1 of the Originating Summons was dismissed and paragraph 2 fell away.
