The order nisi for costs in favour of the Plaintiff is set aside because the Defendant had paid sums into court by 19 October 1994 exceeding the likely judgment and the Plaintiff unreasonably refused that sum; accordingly Plaintiff is entitled to costs only up to 19 October 1994 and Defendant is entitled to costs thereafter.
