Section 16 must be read purposively: where a liability in relation to the common parts is one owed by the owners as a whole and runs with ownership it becomes enforceable against the incorporated owners to the exclusion of individual owners, including liabilities incurred before incorporation; however whether a particular deficit is such a collective liability is a factual question and summary judgment was inappropriate except as to the agreed post-incorporation sum.
