The District Court lacks jurisdiction to entertain an ex parte application for a declaration that a named person is presumed dead because the application does not raise a title dispute within s36 DCO, section 48 cannot be used to create jurisdiction, and established authorities disallow ex parte declaratory proceedings of this nature; accordingly the application is dismissed.
