Refusal to register the applicant as a voter on the sole basis of non‑indigenous lineage was an unreasonable and unlawful restriction of his voting rights under Basic Law Article 26 and ICCPR Article 25; the exclusion also constituted unlawful sex discrimination under the Sex Discrimination Ordinance; accordingly declarations were granted; mandamus and injunction were withheld because no responsible decision‑maker was clearly identified.
