On the pleadings and the expert report, and given defendant's failure to file a defence (deemed admission of particulars), the court concluded the plaintiff established that water leakage from the defendant's unit caused damage, that the defendant breached obligations under the DMC and s34H BMO and/or committed nuisance/negligence, entitling plaintiff to interlocutory judgment, injunctive and mandatory relief and damages to be assessed.
