Section 4(4) of the Detention Centres Ordinance is mandatory; a court shall not make a detention order unless the Commissioner has within the prescribed period informed the court that the young offender is suitable and that a place is available, therefore detention for the second appellant runs from the date (18 May 1978) of the Commissioner’s report accepting him.
