Paragraph 12.1 of the Terms of Tender required tenderers to comply with each and every clause of the Specifications at the time of tendering; clause 16.3.10 and Contract Schedule 4 obliged tenderers to commit to the quantities of spare parts specified in the Specifications (including two full sets of microphones under clause 2.1.3); the plaintiff's tender failed to commit to the required spare microphones and was therefore non-compliant and properly rejected by the Government; no process contract arose and the appeal is dismissed.
