Section 26 of the Gambling Ordinance expressly excludes the application of s.102 of the Criminal Procedure Ordinance and mandates forfeiture where property has been used in or for or in connection with unlawful gambling; therefore the High Court has no broader discretion than a magistrate and the application for return must be dismissed.
