The court granted the interlocutory mandatory injunction ordering D1 to transfer the Funds to his USD account in Hong Kong because the plaintiff established a serious question to be tried combined with a real risk of injustice if the funds remained in the US (asset shortfall and risk of criminal conviction), and because the transfer was inexpensive, reversible, would not pre-empt trial and no prejudice to D1 was shown; therefore the balance of convenience favoured the plaintiff.
