The court exercised its discretion under MLO s.18(3) to enforce the margin agreement as to principal but limited interest as an equitable modification: defendant was credited with the value of both allocated and unallocated securities as at 19 January 1998 producing an adjudged principal of HKD 230,540.50; interest awarded at prime +1% from the date of Writ (12 April 2005) to judgment, thereafter at judgment rate; defendant's counterclaim for commission and set-off dismissed.
