Expert evidence on market practice and on technical differences between the two ICC versions is admissible and necessary to assist the court on those factual/professional practice matters; given the limited pool of local experts, identifiable issues and proportionality relative to the US$1.3m claim, a single joint expert from Hong Kong (Mr Philip Bilney) should be appointed to report within 60 days, with costs initially shared equally and ultimate costs in the cause.
