The court exercised its discretion to fix reasonable retention sums per action on the material before it, accepted that the retention may include further legal costs to protect mortgage rights but limited the quantum to amounts the court considered sufficient on a reasonably arguable best case basis, and held that the plaintiff's costs of the actions be on an indemnity basis and taxed if not agreed while excluding unspecified 'further legal costs' from taxation until their nature and quantum are disclosed.
