The Court accepted the trial judge's factual findings that the defendant's placement of articles obstructed the staircase from 5/F to the roof, materially delayed the plaintiff's ascent and increased her exposure to very high temperatures (chimney effect), which materially contributed to her serious burns; and interpreted "means of escape" in s14 Cap 95F to include the whole staircase to the roof, dismissing the appeal and affirming the trial judgment with indemnity costs awarded to the plaintiff.
