Defendant discharged obligations by delivering 467 pieces to the plaintiff's agent at the terminal; plaintiff's claim for the 40 missing pieces failed because delivery to agent occurred and shipping documents were amended accordingly, but the Japanese survey established a shortfall in yardage (about 1,244.6 yards) for which defendant was liable; damages of $8,089.90 awarded to plaintiff with costs largely against plaintiff given unnecessary litigation on the abortive claim.
