The court found on the balance of probabilities that the applicant was employed by R1 on 9 Oct 2014 and suffered a workplace accident arising out of and in the course of that employment; the court preferred the applicant's evidence over R1's director, applied s.9(1A) using the Hong Kong Paper Mills formula to fix LOEC at 38%, and awarded total compensation of HK$611,292 plus interest and costs as ordered.
