The Court of Appeal held the judge below erred in striking out the petitions for want of locus: the petitioner remained a registered shareholder because instruments of transfer were retained by the stakeholder and annual returns continued to show him as member; therefore disputes over beneficial ownership do not defeat locus to present contributory or member petitions and the summonses to strike out should have been dismissed; appeals allowed and costs ordered against the 2nd respondent.
