The Club failed to comply with its Articles and the rules of natural justice in the disciplinary proceedings; those determinations (suspension and termination) were therefore of no legal effect, but the plaintiff had returned to Hong Kong without notifying the Club and was liable for subscriptions for the intervening period; accordingly the Club's counterclaim for subscriptions was allowed while reinstatement was refused and no order as to costs was made.
