The court found on the balance of probabilities that the parties concluded a binding oral contract (as varied in June 2006) to sell the Property for HK$260,000 with completion after the mothers death, the memorandum was authentic and constituted a sufficient memorandum under s3 Cap 219 (it evidenced parties, property, price and agreed terms, and acknowledged payment of the HK$30,000 deposit), the mothers consent was established on the evidence, and there was no undue influence; accordingly specific performance was ordered.
