The plaintiffs failed to prove a good title because they did not produce the original 1957 Conveyance nor the power of attorney required by s13(1)(c) C&PO and possession alone does not cure the absence of the required documentary root; nevertheless, given long undisturbed possession (over 20 years) and only technical defects, the title is a marketable holding title and the Court will declare it marketable but will not declare it a good title.
