The Court granted the certificate because the nature of the fault element in manslaughter by gross negligence is a question of great and general importance warranting consideration by the Court of Final Appeal and, for present purposes, the Court was prepared to assume that an appeal to the Court of Final Appeal may lie from a s81 reserved question of law.
