    香港特別行政區 訴 李曉峯

    Citation
    [2026] HKCFI 656
    Court
    Court of First Instance
    Case number
    HCMA492/2024

On full re‑hearing the court accepted the trial judge’s credibility findings, held the P2 video incontrovertibly showed deliberate filming of the complainant’s skirt and underwear, found minor inconsistencies in witness detail immaterial, concluded appellant’s epilepsy and character evidence could not plausibly explain the deliberate adjustments and angles in P2, and therefore the prosecution proved the offence beyond reasonable doubt; appeal dismissed.

    香港特別行政區 訴 蔡國佳

    Citation
    [2025] HKCFI 642
    Court
    Court of First Instance
    Case number
    HCMA345/2024

CCTV footage objectively captured the appellant removing a shoe box from the shop, placing it into his cart, walking out of the shop and only replacing the item after being confronted by security; those facts established both the physical act and the necessary intent to dishonestly appropriate the item beyond reasonable doubt, and the appellant's significant prior theft convictions justified an 8-month custodial sentence which was not manifestly excessive.

THE QUEEN v. LO YUNG KAN

    Citation
THE QUEEN v. LO YUNG KAN
    Court
    Court of Appeal
    Case number
    CACC130/1985

The trial judge's directions were legally sound and adequate; the evidence did not support that provocation or self-induced intoxication could have negated the requisite subjective intent to cause grievous bodily harm; the reference to premeditation related to prior planning and did not improperly require an objective test of foresight; accordingly there was no ground to allow the application for leave to appeal.
